What is the standard notice period for confirmed employees in the UAE?
Under Article 43 of Federal Decree-Law No. 33 of 2021, the notice period for a confirmed employee is whatever is agreed in the employment contract, but it must fall between 30 and 90 days. Any clause requiring less than 30 or more than 90 days is not enforceable, so if your contract states an out-of-range figure, the legal minimum or maximum applies instead.
What notice period applies during probation?
If the employer ends the contract during probation, at least 14 days' written notice is required. If the employee resigns during probation to leave the UAE, 14 days' notice applies. If the employee resigns during probation to join another employer within the UAE, 30 days' notice (one month) applies instead.
Can I leave before my notice period ends?
You can, but whichever side ends the relationship without serving the full notice generally owes the other side compensation equal to salary for the unserved portion — this is often called payment in lieu of notice. Some contracts also allow both sides to agree in writing to waive the remaining notice.
Does my notice period still apply if I resign right before probation ends?
Yes. If your resignation is submitted while you are still officially within the probation window — even a day or two before it ends — the probation notice rules apply, not the longer confirmed-employee notice period.
